SMMTAKE.COM - TERMS OF SERVICE & USER AGREEMENT
1. ACCEPTANCE OF TERMS
1.1. By signing up on SMMTAKE.COM, the User confirms that they have read, understood, and accepted all Terms of Service.
1.2. Users who do not agree with these Terms must not create an account or use any service provided by this platform.
1.3. Creating an account, logging in, placing an order, depositing balance, or using the API is considered full and legally binding acceptance of this Agreement.
2. NATURE OF SERVICE & DISCLAIMER
2.1. SMMTAKE.COM provides digital marketing services intended for promotional and visibility purposes only. No organic or permanent growth is guaranteed.
2.2. Non-Affiliation: We are not affiliated with, endorsed by, or partnered with Meta, Instagram, TikTok, YouTube, or any other social media platform.
2.3. Force Majeure & Platform Updates: Social media networks frequently update their algorithms and security protocols. Such updates are considered "Force Majeure." During or following major updates, any delivery guarantees or "Refill" policies are strictly suspended and rendered null and void.
3. ORDERS, REFILLS & LIMITATIONS
3.1. Account Status: The User is solely responsible for ensuring target accounts are set to "Public." No refills or refunds will be issued for private, restricted, or deleted accounts.
3.2. No Guarantee on Drops: Unless a specific "Refill" period is stated in the service description, we provide no guarantee against drops caused by platform policy changes or security filters.
3.3. Finality of Orders: Due to automated infrastructure, once an order is placed, it cannot be canceled, modified, or stopped.
4. PAYMENT, BALANCE & UNIFIED BILLING
4.1. No External Refunds: All funds deposited into the SMMTAKE.COM wallet are final. Deposited balance cannot be refunded to the original payment method (Credit Card, Crypto, etc.).
4.2. Unified Service Package: Regardless of quantity or type, all individual micro-orders are considered part of a single integrated “Social Media Service Package.” For invoicing and legal purposes, all services appear as one combined Digital Marketing Package.
4.3. Fraudulent Payments: Any unauthorized card usage or chargeback attempts will result in immediate account termination and forfeiture of any remaining balance.
5. API USAGE RULES
5.1. The API must be used within rate limits. Abuse, excessive requests, or scraping attempts will result in a permanent API block.
5.2. The User accepts full legal and financial responsibility for all orders generated through their unique API key.
6. COMMUNICATION ETHICS & ACCOUNT TERMINATION
6.1. Zero-Tolerance for Abuse: We maintain a strict policy protecting our staff and support agents. Any form of insult, profanity, derogatory language, or threats directed toward our personnel will result in a permanent ban.
6.2. Liquidated Damages: Upon termination due to abusive behavior, SMMTAKE.COM reserves the right to liquidate any remaining wallet balance as compensation for operational disruptions and service violations.
7. LIMITATION OF LIABILITY
7.1. SMMTAKE.COM is not liable for account bans, suspensions, shadowbans, or reputational damages caused by the use of our services. The User accepts full legal responsibility for their actions.
8. GOVERNING LAW & DISPUTE RESOLUTION
8.1. This Agreement is governed by the laws of the State of Delaware (United States).
8.2. Binding Arbitration: All disputes shall be settled through binding arbitration. Both parties waive their right to a jury trial or class-action lawsuits.
9. MODIFICATION OF TERMS
9.1. We reserve the right to update these Terms at any time. Continued use of the platform constitutes acceptance of the updated Terms.
